  2. "Software Licensing Agreement" for 'Digital Peace LIGHT', all versions

  6. Grant of License
  7. ================
  8. The Plastic Factory (TPF) hereby grants to you the right to use one (1) copy
  9. of the enclosed TPF program (the "Software") on a single computer. For
  10. purposes of this section, "use" means loading the Software into RAM,
  11. as well as installation on a hard disk or other storage device.
  12.  
  13. You may not: rent, lease, modify, translate, disassemble, decompile,
  14. reverse engineer, or create derivative works based upon the Software. 
  15.  
  16. The licensed program is licensed, not sold.  Nothing in  this agreement
  17. shall be construed as conveying title in the licensed program to Licensee.
  18.  
  19. The Software, together with any archive copy thereof, shall be either
  20. returned to TPF or destroyed when no longer used in accordance with this
  21. Agreement, or when the right to use the Software is terminated.

  24. All rights not expressly granted here are reserved to TPF.

  28. Distribution
  29. ============
  30. This software may be freely distributed, provided that:
  31.  
  32. 1. Such distribution includes only the original archive supplied by TPF.
  33.    You may not alter, delete or add any files in the distribution archive.
  34. 2. No money is charged to the person receiving the software,
  35.    beyond reasonable cost of packaging and other overhead.

  43. LIMITED WARRANTY AND DISCLAIMER OF WARRANTY

  46. (INCLUDING INSTRUCTIONS FOR USE) ARE PROVIDED "AS IS"
  47. WITHOUT WARRANTY OF ANY KIND.
  48. FURTHER, THE PLASTIC FACTORY (TPF) DOES NOT WARRANT,
  49. GUARANTEE, OR MAKE ANY REPRESENTATIONS REGARDING THE USE,
  50. OR THE RESULTS OF USE, OF THE SOFTWARE OR WRITTEN MATERIALS
  51. IN TERMS OF CORRECTNESS, ACCURACY, RELIABILITY, CURRENTNESS,
  52. OR OTHERWISE. THE ENTIRE RISK AS TO THE RESULTS AND
  53. PERFORMANCE OF THE SOFTWARE IS ASSUMED BY YOU. IF THE SOFTWARE
  54. OR WRITTEN MATERIALS ARE DEFECTIVE YOU, AND NOT TPF OR ITS
  55. DEALERS, DISTRIBUTORS, AGENTS, OR EMPLOYEES, ASSUME THE
  56. ENTIRE COST OF ALL NECESSARY SERVICING, REPAIR, OR CORRECTION.

  58. THE ABOVE IS THE ONLY WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED,
  59. INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY
  60. AND FITNESS FOR A PARTICULAR PURPOSE, THAT IS MADE BY TPF, ON THIS
  61. TPF PRODUCT. NO ORAL OR WRITTEN INFORMATION OR ADVICE GIVEN BY TPF,
  62. ITS DEALERS, DISTRIBUTORS, AGENTS OR EMPLOYEES SHALL CREATE A WARRANTY
  63. OR IN ANY WAY INCREASE THE SCOPE OF THIS WARRANTY AND YOU MAY NOT RELY
  64. ON ANY SUCH INFORMATION OR ADVICE. YOU MAY HAVE OTHER RIGHTS WHICH VARY

  70. (INCLUDING DAMAGES FOR LOSS OF BUSINESS PROFITS, BUSINESS INTERRUPTION,
  71. LOSS OF BUSINESS INFORMATION, AND THE LIKE) ARISING OUT OF THE USE OR
  72. INABILITY TO USE SUCH PRODUCT EVEN IF TPF HAS BEEN ADVISED OF
  73. THE POSSIBILITY OF SUCH DAMAGES.

  75. BY USING THIS PRODUCT, YOU ACKNOWLEDGE THAT YOU HAVE READ THIS
  76. LIMITED WARRANTY, UNDERSTAND IT, AND AGREE TO BE BOUND BY IT'S
  77. TERMS AND CONDITIONS. YOU ALSO AGREE THAT THE LIMITED WARRANTY
  78. IS THE COMPLETE AND EXCLUSIVE STATEMENT OF AGREEMENT BETWEEN
  79. THE PARTIES AND SUPERSEDE ALL PROPOSALS OR PRIOR  AGREEMENTS,
  80. ORAL OR WRITTEN, AND ANY OTHER COMMUNICATIONS BETWEEN THE PARTIES
  81. RELATING TO THE SUBJECT MATTER OF THE LIMITED WARRANTY.
